Terms of Service

1. Acceptance of Terms

By accessing and using HangarStay ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

HangarStay is an online platform that connects aircraft owners seeking hangar space with hangar owners who have available space to rent. We facilitate bookings but are not a party to the rental agreements between users.

3. User Accounts and Registration

To use certain features of our Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Responsibilities

For All Users:

  • Comply with all applicable laws, regulations, and airport rules
  • Provide accurate information in all communications
  • Treat other users with respect and professionalism
  • Not use the Service for any illegal or unauthorized purpose
  • Maintain appropriate insurance coverage for your activities

For Renters:

  • Ensure your aircraft meets all safety and regulatory requirements
  • Respect hangar property and follow all rules and restrictions
  • Pay all fees and charges in a timely manner
  • Report any damage or incidents immediately to the hangar owner
  • Maintain valid pilot certificates and aircraft documentation

For Hangar Owners:

  • Provide accurate descriptions and photos of your hangar
  • Maintain your hangar in safe and usable condition
  • Honor confirmed bookings and provide agreed-upon services
  • Comply with all local zoning and business licensing requirements
  • Respond promptly to renter inquiries and communications

5. Booking and Payment Terms

When you make a booking through HangarStay:

  • You enter into a direct agreement with the hangar owner
  • Payment processing is handled securely through our platform
  • Service fees are clearly disclosed before booking completion
  • Cancellation policies are set by individual hangar owners
  • Refunds are subject to the applicable cancellation policy
  • Disputes should first be resolved directly with the hangar owner

6. Service Fees

HangarStay charges service fees to cover platform costs, customer support, payment processing, and platform maintenance. Fees are clearly displayed before booking completion and are non-refundable except as required by law.

7. Prohibited Uses

You may not use our Service to:

  • Violate any laws, regulations, or third-party rights
  • Post false, misleading, or fraudulent information
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to other accounts
  • Use automated systems to access the Service
  • Circumvent any security measures or access controls
  • Harass, abuse, or harm other users
  • Infringe on intellectual property rights

8. Intellectual Property

The HangarStay platform, including its design, functionality, text, graphics, and other content, is owned by HangarStay and protected by copyright, trademark, and other intellectual property laws. Users retain ownership of content they post but grant HangarStay a license to use such content for platform operations.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using HangarStay, you consent to the collection and use of information as described in our Privacy Policy.

10. Disclaimers and Limitation of Liability

HangarStay provides the platform "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of information
  • Uninterrupted or error-free operation
  • Security of data transmission

HangarStay's liability is limited to the maximum extent permitted by law. We are not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Actions or omissions of hangar owners or renters
  • Aircraft damage, theft, or other property loss
  • Personal injury or death

11. Indemnification

You agree to indemnify and hold harmless HangarStay, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through:

  • First, good faith negotiations between the parties
  • If unsuccessful, binding arbitration under the rules of the American Arbitration Association
  • Arbitration will be conducted in the state where HangarStay is headquartered
  • Class action lawsuits and jury trials are waived

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any legal action must be brought in the courts of New York.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
